Jaxscard.com Prepaid gift card Terms of Service
This is a legal contract between Jaxscard.com and its Customers. Customer agrees to be bound by these terms whether signed or unsigned. Use in any manner whatsoever of services provided by Jaxscard.com constitutes explicit agreement to be bound by these Terms of Service. Any Customer who does not agree with these Terms of Service should immediately stop using all services provided by Jaxscard.com and contact Jaxscard.com to cancel such services. The sole and exclusive remedy of any Customer who is dissatisfied with Jaxscard.com or any of its terms, conditions, rules, policies, guidelines, or practices is to discontinue using Jaxscard.com's services.
You and all users of the Jaxscard.com System approved by you are at least eighteen (18) years of age;
You have the legal capacity and authority to; (a) enter into binding contracts for the sale and purchase of goods and services, (b) be bound by these Terms of Service and the Additional Terms, (c) to subscribe to and use the Jaxscard.com service, including, where applicable, the buying, selling and listing of items, in accordance with these Terms of Service and any Additional Terms and (d) if you are acting in a corporate capacity, to bind Your company
You will not use the Jaxscard.com System for any purpose that is unlawful, or prohibited by these Terms of Service or the Additional Terms (as may be modified from time to time); All information supplied by You or by others using Your account is true and accurate, including information submitted as part of the registration process.
Customer agrees to indemnify, defend, and hold harmless Jaxscard.com from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action, or claims caused by or resulting directly and/or indirectly from Customer's use of any Jaxscard.com service which damages either the Customer, Jaxscard.com, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with Customer's use of services provided by Jaxscard.com.
Jaxscard.com reserves the right to refuse or discontinue service to anyone at Jaxscard.com's sole discretion. Jaxscard.com may deny Customer access to all or part of Jaxscard.com's services without notice if Customer engages in any conduct or activity that Jaxcard.com in its sole discretion believes to violate any of the terms and conditions contained herein. Jaxscard.com shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification.
MERCHANTS
Any products or services advertised, sold or otherwise distributed by You on or in connection with Your Web Site are legal for sale or distribution; that you have all licenses necessary to sell or advertise the goods or services offered for sale or distribution and that all sales and advertisements will be in compliance with applicable law; and
You have and control all of the intellectual property, proprietary and similar rights necessary for all material located on Your Web Site, all submissions, and all products and services sold or otherwise distributed by You or on Your behalf via Your Web Site. Adult sites must be in Title 2257 compliance.
BUYERS
Jaxscard.com is not redeemable for cash or applied to your Credit card account(s). Jaxscard is Redeemable for merchandise only at any participating websites.
No expiration date. Any Jaxcard balance remaining may be used for future purchase; however a service charge deduction of 2.99 per month from a balance remaining will commence if there is no activity for a period of 24 months (2 years) on said user account.
In the event that Jaxscard.com terminates Your Jaxscard.com account for violation of these Terms of Service or the Additional Terms, You will not be entitled to the return of any fees paid with respect to any such terminated account service.
CANCELLATION POLICY
You acknowledge that if You cancel any prepaid Jaxcard.com service that You are not entitled to a refund of all or part of amounts already paid by You for such Jaxscard.com prepayments.
Jaxscard.com provides no warranty that Jaxscard.com's services will be uninterrupted or error-free. Jaxscard.com assumes no liability, express or implied, for any downtime for any reason. fixed service fees for the day in question only. Jaxscard.com will not be held liable for revenues lost by Customer for any reason.
